Terms & Conditions
Welcome to Toonyug Animation. These Terms and Conditions govern the purchase and professional usage of 2D/3D animated characters, rigs, audio, and digital courses provided by our studio. By purchasing an asset, you agree to be legally bound by this agreement under the Indian Contract Act, 1872.
1. Ownership & Intellectual Property
- Founder & IP Owner: All digital assets, including character designs, rigs (FLA/PSD), and animation sequences, remain the exclusive intellectual property of Harsh Kumar (Founder, Toonyug).
- Legal Protection: Our assets are protected under Section 13 of the Indian Copyright Act, 1957, and international treaties like the Berne Convention.
- No Ownership Transfer: Purchase of a license grants "Usage Rights" only; it does not transfer the copyright to the buyer.
2. License Categories & Usage Limits
A. Creator License (Personal)
Usage: Valid for One (1) Authorized YouTube Channel or social media handle only.
Restrictions: You cannot use these assets for client work or on multiple channels.
Collaboration: You may feature the final video on a maximum of 2 Guest Channels, provided source files are never shared.
B. Commercial License (Business)
Usage: Valid for Unlimited Channels and professional client projects.
Multi-Platform: Best for animation agencies and production houses.
Strict Rule: Reselling or redistributing original source files (FLA, PSD, Rig) is strictly prohibited.
3. Critical Restrictions (Zero Tolerance)
- No Redistribution: Prohibited from sublicensing, reselling, or sharing source files on any marketplace (Fiverr, Freepik, etc.) or public cloud.
- AI & NFTs: Usage for AI Training Datasets or NFT minting is strictly forbidden without an "Extended Studio License."
- Upgrades: Creator License holders must pay the Price Difference to upgrade to Commercial.
4. Privacy & Sales Transparency
- Social Proof & Notification: By purchasing an asset, the buyer agrees that their First Name and City/Location may be displayed in the "Recently Purchased" notification popup on the Toonyug website.
- Purpose: This activity is used solely for building community trust and verifying real sales for other creators.
- Data Protection: No sensitive information (Email, Phone, Full Address) will ever be displayed publicly.
5. Refund & Technical Support
- No-Refund Policy: Due to the digital nature of source files, no refunds are provided once the file is accessed.
- File Replacement: Technical defects in a rig or file will be replaced by a fixed version.
- Verification: Toonyug reserves the right to audit channel ownership to verify license compliance.
6. Legal Assurance & Enforcement
- Copyright Safety: Each purchase includes a Unique License ID, acting as proof against false copyright strikes.
- Penalties: Unauthorized use results in immediate termination and legal action under Section 63 of the Copyright Act, 1957.
- Jurisdiction: All disputes are subject to the exclusive jurisdiction of the Courts in New Delhi, India.
